TERMS AND CONDITIONS AGREEMENT

 

By making a payment towards the invoice you hereby acknowledge and accept the Terms and Conditions set out in this agreement and all terms set out in your invoice. Please read the following carefully. Please note these Terms and Conditions are subject to change.

Let's Style Interiors PTY LTD provides the services of Property styling and staging for the specific purpose of assisting clients, real estate agents, trusts and companies in selling residential/ commercial properties.

Our services should only be engaged when person/s seek to style residential/ commercial properties for the sole purpose of selling and/or leasing the property.  Let's Style Interiors Pty Ltd may request the sale/s contract and or contact from the Real Estate Agency, Conveyancers, solicitors to verify information. Let's Style Interiors Pty Ltd holds the right to change or add to this Terms and Conditions Agreement at any time without notice.

  A copy of this agreement will be made available to all client/s who are issued an invoice and wish to engage Let's Style Interiors Pty Ltd services.

Section A

COVID – 19 and LOCK DOWN Period

  1. Social Distancing Regulations - client/s must vacate their property during delivery, installation, pack up and collection including and not limited to ceasing all other trade work.

  2.  If client/s or any other persons in their house contract COVID – 19 during the hire period, Let’s Style Interiors PTY LTD must be advised in writing. All items installed at the property must be packed and kept away in a safe, no sun and watertight area. Client/s must advise Let’s Style Interiors PTY LTD their isolation time and virus management procedure whether they will be at home or hospital during this time.

  3. Integrated Staged/ Partial Staging - In the event there is a Public Health Orders and/or other State Government and/or Federal Government legislation. Client/s must provide Let’s Style Interiors PTY LTD immediate access to their residence to collect all furniture.

  4. Client/s hire period will be put on hold and a re – delivery will be rescheduled on commencement of normal business activity. Client/s remaining hire period will commence from the date of re – delivery. A re-delivery fee will apply of $550.00.  No refunds will be provided.

  5. Full Staging - Furniture will remain onsite during the lock down period. The hire period will continue unless there is a period of time when showing of the property for sale or lease is prohibited under Public Health Orders and/or other State Government and/or Federal Government legislations. No refunds will be provided.

Section B

Furniture, Accessories, Furnishings

  1. All furniture placed on the property is owned entirely by Let's Style Interiors Pty Ltd. At no time during the hire period will the furniture, furnishings, accessories including all plants, décor items and any other items used for the purpose of staging/styling will be passed on in ownership to the client/s.

Section C

Client/s responsibility

  1. The Client/s is wholly responsible for ensuring all item/s do not incur any wear, damage, stains, scratches, markings, tears, scuffs, or miss – use for the duration of the hire period and any extension hire period.

  2. Client/s will be held responsible for any item/s that incur wear, damage, stains, scratches, markings, tears, scuffs, and/or or miss – use of any furniture, and/or furnishing items installed at the premises.

  1. Any furniture and/or items that are past the point of repair or refurbishment will not be accepted as a return, the client/s bond will be withheld fully, and additional replacement cost will be charged.

Section D

Removal of existing furniture

  1. Let's Style Interiors Pty Ltd will not be responsible for moving any existing furniture at the property.

  2. Let's Style Interiors Pty Ltd will not be held liable for any damage occurred to the client/s existing furniture or fixtures due to the installation process and/or removal process. The client agrees to release Let’s Style Interiors of any liabilities for any damage, property loss, and/or financial loss occurred during the installation and/or removal process.

Section E

Payment

  1. A non - refundable 50% deposit is due on booking.

  2. Full balance is payable a minimum 14 days prior to installation date and/or at the time of confirming an installation date.

  3. Booking Deposits do not guarantee or allocate a date/time for installation.

  4. Failure to pay the full balance within these stated terms may delay and/or halt the installation entirely. This may cause your installation date and time to be allocated to another party.

 Section F

Refunds

  1. Refunds will not be paid if the Client/s cannot proceed with the agreed date due to change of mind, finding a better price, and or/any other reasons that may arise preventing client/s from proceeding with the installation.

  2. Let's style Interiors Pty Ltd does not provide any refunds or exchanges based on change of mind and/or if the Client/s does not like the furniture, soft furnishings, and decoration pieces.

  3. Let’s Style Interiors PTY LTD will not provide refunds in the event of State Government and/or Federal Government legislation and/or sanctions where Let’s Style Interiors PTY LTD is prohibited to operate either in a state and/or local government area and/or any other circumstances which it out of Let’s Style Interiors PTY LTD measurable control due to unforeseen circumstances and/or not limited to fire, flood, extreme weather conditions, pandemic, epidemic, and viral outbreak, and any other major health concerns effecting the region, local government area and/or suburb where the premises is located.    

  4. the client/s agree to release Let’s Style Interiors PTY LTD of any liability for financial loss, material loss, and/or any losses which might result from the delay or stop work restriction imposed on Let’s Style Interiors PTY LTD and/or any third parties involved in the operations or delivery of the service.

  5. Refunds will not be provided due to any stop work sanctions, prohibitions and/or legislations that prevent Let’s Style Interiors PTY LTD to continue work instead we will seek to provide you a future date outside of the prohibited work period and/or provide client/s with a credit less 30% to be used within 12 months.

Section G

Change of Mind Policy

  1. The Client/s will be charged $350.00 + $220.00 re - delivery fee if the Client/s request to change any larger or bulkier items. Any changes to furniture will be subject to availability of stock.

Section H

Furniture, Accessories, Furnishings

  1. All furniture placed on the property is owned entirely by Let's Style Interiors Pty Ltd. At no time during the hire period will the furniture, furnishings, accessories including all plants, décor items and any other items used for the purpose of staging/styling be passed on in ownership to the client/s.

Section I

Furniture Hire Period

  1. Let's Style Interiors Pty Ltd is renting furniture to (you) the Client/s whom the invoice is Billed to for a maximum term of 6 weeks unless the property is unconditionally under contract prior to the 6 weeks term, or an extension is granted.

  2.  Let's Style Interiors Pty Ltd holds the right to refuse any extension/s on furniture hire.

  3. The Client/s whom the invoice is billed to is wholly responsible for the safe keeping and good condition of the furniture and all items installed at the property for the entire duration of the hire period including the period of any extension/s that may be granted past the initial hire period. As outlined in section c and may be liable to charges as outlined in section I 

Section J

BOND

  1. Integrated Staging - a refundable bond amount of $500 is payable. The Bond is refunded once all furniture, furnishings and décor items have been successfully collected by Let's Style Interior's Pty Ltd and the company's sub-contractors. All items must be returned in the same conditions as installed and all the conditions under section c have been complied to.

  2. Partial Staging - a refundable bond amount of $1000 is payable.

  1. The Bond is refunded once all furniture items have been successfully collected by Let's Style Interior's Pty Ltd and the company's sub-contractors.

  2. All items must be returned in the same conditions as installed and all the conditions under section c have been satisfied.

  1. Bonds can be used to deduct full or part payment towards professional cleaning, repair and replacement charges. Refer to section J

Section K

Professional Cleaning, Repair and Replacement Charges

  1. Professional Cleaning and Repair - in the event furniture, furnishings, décor items require professional cleaning and/or repair the full bond amount will be deducted.

  2. Replacement - in the event of replacement cost will be charged at RRP plus an additional service fee of $550.00 ex GST will be charged for the cost of collecting the item/s from the property. The full bond amount will be deducted to cover this cost and the remainder amount will be billed to Client/s.

Section L

Client/s Sub – Contractors, Affiliates

  1. Let's Style Interiors Pty Ltd will not accept any liability for damage caused to the premises by the installation of any item/s placed in the property by the Client/s and/or the Client/s sub-contractors, and/or affiliates.

Section M

Photography, Videography, social media and Website

  1. Photographs and Videos - Let's Style Interiors Pty Ltd will take photographs and video of the work completed for stocktake and to promote our work and business across all social media platforms including and not limited to third party websites for marketing purposes.  

  2. All photographs and videos taken as part of this service are entirely owned by us and may not be reused without our permission.

  3. Let’s Style Interiors PTY LTD reserves the right to use photographs and videos including and not limited to before/after photos and videos for purpose of promoting Let’s Style Interiors’ services, promotions, and business.

Section N

Artwork, Wall Art, Mirrors and other Hanging Work (Wall Anchors, nails, fixtures, drilling)

  1. Let's Style Interiors Pty Ltd and the company’s sub-contractors may use Wall Anchors, hooks, nails, and/ or any other hanging devices in the property for the purpose of securing Art, Wall Art, TVs, Mirrors including and not limited to Hanging decorative work.

  2. Let’s Style Interiors and or sub-contractors may need to drill concrete and double brick walls to ensure to fix and secure certain items to concreate and/or double brick walls.

  3. The client accepts that although all reasonable care is taken to minimise marking, nail points and/ or damage to the wall, the condition and the appearance of the wall will change.

  4. It is a reasonable expectation that concrete, double brick, and gyprock walls may be damaged during this process.

  5. Let's Style Interiors Pty Ltd will not accept any liability for the damage and/or cost/s incurred to fix the damage due to the process of installation of artwork, mirrors, and any other decorative wall hangings.

  6. the client/s agree to release Let’s Style Interiors PTY LTD of any liability for financial loss and/or property damage caused due to this service.

Section O

Delivery, Installation, Pack Up and Collection

  1. Installation Process - Let's Style Interiors Pty Ltd will not be held liable for any damage/s incurred during the process of installation and collection of the furniture.

  2. Let's Style Interiors Pty Ltd may subcontract the services of external Removals  Companies.

  3. Let's Style interiors Pty Ltd will provide Client/s the contact information of the removalist business/company used for the installation and collections process when requested.

  4. The Client/s agree to release Let's Style Interiors Pty Ltd of any liability for financial loss and/or property damage whether directly or indirectly due to the actions of all sub-contractors and third parties involved in the delivery and installation and pack up and collection process of all furniture, accessories, décor including and not limited to any other items on the property.

Section P

Cleaning of Property before and during the hire period.

  1. Premises must be cleaned prior to the installation day, all areas where furniture is to be installed must be clear of dirt, water, debris and any other materials that may soil or damage furniture, furnishings and décor items.

  2. Client/s maybe held liable under Section K for any furniture items and/or furnishings that require cleaning due to client/s negligence to have the premises cleaned prior to installations.

  3. Client/s is responsible for the upkeep, cleaning and maintenance of the premises during the furniture hire period.   

Section Q

Reschedule of Pre-booked Installation

  1. Client/s must advise Let’s Style Interiors PTY LTD a minimum 72 hours prior to the installation date of any rescheduling required

  2. All rescheduling within 72 hours maybe subject to a re-delivery fee of $550.00 + $130.00 admin charges.

  3. Rescheduling is subject to availability and does not guarantee client/s a date and/or time for installation.

  4. Let’s Style Interiors does not provide refunds. Please see Section F

Section R

Delays during installation process

  1. All delays by the fault of the Client/s and the Client/s affiliates and/or subcontractors will be subjected to the terms as outlined in this agreement.

  2.  Client/s will be responsible to pay $280 per hour for a maximum of 5 hours + $35.00 fee.

  3. Let's Style Interiors Pty Ltd may cease the installation and reschedule fees as outlined in Section Q will be applicable.

  4. Client/s agree to reimburse Let’s Style Interiors PTY LTD for any financial losses incurred by any delays that result in the installation being rescheduled because of this section.

Section S

Other Trade Work onsite during Installation and Collection

  1. All other trade work must be halted during the installation and pack up process. See section A 1)

  2. Failure to comply may result in Let's Style Interiors Pty Ltd ceasing and/or halting the installation entirely.

  3. In the event the installation is stopped, section R will be applicable.

  4. Client/s agree to release Let’s Style Interiors PTY LTD of any liabilities for any financial losses caused due to the delays of such activities.

Section T

Use of HOT/COLD Water, Electricity and Functioning Toilets

  1. Interiors Pty Ltd requires the use of running hot and cold water, electricity,

  2. and functioning toilet.

  1. Water is used by our staff to fill steamers, irons, wash hands, fill up water bottles.

  2.  Electricity is used for power tools including and not limited to irons and drills and

  3. functioning toilet is required for our staff during their time onsite.

 Section U

Collection of furniture/ furnishings/ items

  1. Let's Style Interiors Pty Ltd will schedule a collection one day after the hire term has expired and/or once the property is unconditionally under contract (whichever comes first), or

  2. If client/s failure to comply with or accept the terms and conditions as outlined in this agreement.

  3.  Let's Style Interiors Pty Ltd and the company's sub-contractors hold/s the right to gain access to the property for the purpose of furniture removal by providing 24hrs notice to the Client/s and/or anyone acting on behalf of the Client/s.

Section V

Access to the Property/ Restrictions/ PERMITS

  1. Client/s must provide full access to the premises on installation and collection date including but not limited to the main door, side, and rear access.

  2. Client/s agree to release Let’s Style Interiors PTY LTD of any liabilities for any financial loss and/or property damage as a result of restricted access to the premises and/or when an item/s are underivable.

  3. Client/s are responsible to ensure that all accesses are made available to the property and that no hazardous materials, items and/or persons are restricting access including and not limited to council permits, low powerlines, extreme terrain, no parking/standing zone, tight or restricted driveway, common and/or communal grounds, and strata managed complexes.

  4. In circumstances where client/s fail to advise Let’s Style Interiors PTY LTD of any restrictions and/or permits to the property, the client/s will be liable for all delays and losses incurred by Let’s Style Interiors PTY LTD under Section Q

Section W

Insurance

  1. Fire, Water Damage, Theft (forcible entry only)

  1.  In the event of fire, theft (forcible entry), water damage where either some or all the stock is not recoverable

  1. Client/s agree to pay a $1000.00 + gst insurance excess and $230 admin fee directly to Let's Style Interiors Pty Ltd.

  2. The Client/s must obtain a police report within 24 hours of offence occurring and/or as soon as client is made aware of the offence occurring

  3. Client/s must provide Let's Style Interiors all copies of the police report relating to the incident and any other documents, evidence, including and not limited to photographs and video footage of any incident relating to the circumstance/s which led to any loss of stock placed on the property.

Flood

  1. In the event of flooding, the Client/s will be responsible for full replacement value of all non-recoverable stock placed on the property.

Other Circumstances and Theft (no forcible entry)

  1. Client/s will be wholly responsible for theft and/or incidental damage occurring resulting in the loss, damage, or

  2. In unrecoverable circumstances such as repossession of premises by banks and/or any other third parties that hold a financial interest in the premises 

Section X

Extension and Hire Terms

  1. Extension/s of furniture hire will be subject to availability and will be determined at the time of Client/s request to extend the furniture.

  2. No prior costs for extension periods will be granted. Client/s must advise Let's style Interiors Pty Ltd a minimum 7 days prior to the hire term expiration date if an extension is required.

  3. Client/s will be provided with a Hire Term Fee Schedule subject to availability.

  4. Client/s must pay the balance within 24 hours of receiving the Hire Term Fee Schedule. 

  5. Let's Style Interior's Pty Ltd reserves the right to refuse any extensions on furniture hire.

Debt Collection

  1. Reasonable attempts to contact client/s will be made to collect any monies payable and outstanding to Let’s Style Interiors PTY LTD for our services including and not limited to bonds payable.

  2.  Let’s Style Interiors PTY LTD will refer your case to an external debt collection agency. This process will incur additional fees which will be passed on Client/s.  

  3. Let’s Style Interiors PTY LTD reserves the right to lodge caveat/s on the premises concerned as a last resort should client/s not make a reasonable attempt to contact Let’s Style Interiors PTY LTD in relation to outstanding balances and monies owing.
